Evaluation Criteria for Intellectual Property Lawyers

First we focus on the firm’s knowledge of general intellectual property issues.  How often does the firm handle intellectual property cases?   Do they have a solid understanding of intellectual property rights? 

Next we review each firm’s handling of copyright infringement issues. Is the firm knowledgeable in cases when one individual is accused of stealing an idea or content from another whether in court or helping to resolve the issues outside of court? 

We then analyze the firm’s drafting of cease and desist notices.  Do the attorneys assist their clients in drafting notices or understanding the legal responsibilities to act if accused of stealing intellectual property or infringing upon the rights of another?

Another aspect of our evaluation focuses on the firm’s assessing and reporting of damages cause by the stolen intellectual property.  Does the firm work in house to understand the value of any intellectual property damages, or does the firm hire an independent authority? 

Lastly we focus on the firm’s understanding of the process of filing for patents and trademarks on a name or invention.  Is the firm able to guide their client through the process of filing a patent in order to protect an idea from being copied, stolen, or used without permission of the inventor or creator?
