Counsel II Job Description
Overview: Real estate transactions attorney reports to Senior Counsel and provides legal support for Windstream's OSP Engineering and other business units responsible for network real estate and fiber builds. Candidates must have strong analytical, drafting, negotiations and problem solving skills. The successful candidate will be part of a team of attorneys whose primary responsibility is to review and negotiate real estate transactions on behalf of Windstream and to manage other legal issues common to real estate and business transactions.
General Summary:
5-10 years of legal experience in reviewing, drafting and negotiating various network and real estate agreements including pole attachment agreements, licenses, rights-of-way agreements, permits, franchises, leases, easements, property acquisition/conveyances, IRUs, and railroad agreements.
Coordinate the drafting of negotiated deals and work with client/business owners or supervising attorney to determine acceptable terms.
Researching and obtaining information regarding rules, regulations, municipal codes which would affect the development of a site.
Provide legal advice to the company on a variety of real estate and business transactions and assist in monitoring, maintaining and implementing processes and procedures to meet business objectives.
Strong verbal and written communications skills, as well as the ability to convey positions in a clear concise, professional and effective manner appropriate to the audience and circumstance. Requires the ability to work independently and efficiently manage numerous projects simultaneously.
Desired Minimum Requirements:
JD degree, plus current law license in good standing
Strong academic credentials
Experience in the telecommunications industry, FCC and/or state utility commission rules and procedures desired.
Minimum Requirements:
College degree and 8+ years professional level experience with 3-4 years supervisory experience; or 12+ years professional level related experience with 3-4 years supervisory experience; or an equivalent combination of education and professional level related experience required.
